The regular monthly meeting of the St. Matthews City Council was called to order by Mayor Bowling at 7:01 p.m.  The meeting was held at St. Matthews City Hall, 3940 Grandview Avenue.  The following people were present:

MINUTES
A motion was made by Councilman Tonini to approve the minutes from the May 8, 2012 meeting.  The motion was seconded by Councilman Nay.

Upon vote:  (7-0) the motion passed and the minutes were approved.  Councilman Weiter was not present and unable to participate in the vote.

PUBLIC COMMENTS
The time for public comments was offered to anyone in attendance by Mayor Bowling.  No one from the public choose to address the council members.
NEW BUSINESS
MUNICIPAL ORDER  12-07 APPOINTMENT OF SGT. PATRICK HAYDEN
Foster Haunz read Municipal Order 12-07 regarding the appointment of Officer Patrick Hayden as Late Watch Sgt. of the St. Matthews Police Department.  The oath was previously administered.  Sgt. Hayden has been with the STM Police Department for 11 years.  Councilman Tonini made a motion to accept Municipal Order 12-07.  The motion was seconded by Councilman Schade.

Upon vote:  (7-0) the motion was approved. Councilman Weiter was not present at the time of this vote and therefore unable to participate.

MUNICIPAL ORDER 12-09 TEXAS ROADHOUSE ADDITION
Mr. Haunz reviewed Municipal Order 12-09 regarding amending binding elements found in  MO 97-08 for Texas Roadhouse, located at 6460 Dutchmans Parkway.  Councilman Tonini inquired if this involves a change in the exterior footprint of which Mr. Haunz responded affirmatively.     Summed-up simply by Councilman Monohan, it involves the addition of an interior waiting room by removing 8 outside bushes and extending the wall out for a waiting room to the left

upon entering.   A motion to approve MO 12-09 was made by Councilman Tonini.  The motion was seconded by Councilman Nay.
Upon vote:  (7-0) the motion was approved.  Councilman Weiter was not present and unable to participate in the vote.

BROWN PARK CREEK RESTORATION
Councilman Monohan asked the council to review the bid information found in the materials before them. The low bid was from EZ Construction with a price of $534,800.  The difference between $534,800 and the estimated cost of $483,000 was due to a difference in unit pricing not previously included.  Discussion followed regarding the expenditure.  Councilman Tonini made a motion to accept the bid from EZ Construction for $534,800.  The motion was seconded by Councilman Nay.
Upon vote:  (8-0) the motion was approved.

PLAQUE at BROWN PARK
This year marks the 30th anniversary of the birth of Brown Park.  In honor of this noteworthy event, Councilman Monohan asked the council to consider placing a plaque commemorating the five (5) Boy Scouts from Troop #315 who initially cleared brush from the land.  They did so with the intention of this unused plat of land to be developed as a community park.    The endeavor served as the Eagle Project for Kurt Dobbs, Jeff Fulkerson, Matt Jones, Talley Lambert and Cliff Whalin.  The plaque would be similar in size and lettering to a similar plaque placed at Warwick Park.  Councilman Monohan made a motion to purchase a plaque in honor of these Boy Scouts from Troop #315.  The motion was seconded by Councilman Nay.

PENDING BUSINESS
Mayor Bowling pointed out a media advisory that was recently issued by the Louisville Metro Council.  The Federal Railroad Administration (FRA) announced the approval of a Quiet Zone at the Washburn Avenue railroad crossing.   He has been in communication with Metro Councilman Ken Fleming regarding additional safety measures for implementation.  The approximate cost of the work is $75,000.  The expense should be a shared expense among St. Matthews, Lyndon and the Louisville Metro Government.  Councilman Monohan made a motion to approve expenditure up to $75,000 for additional citizen and railroad safety measures to be implemented.  It is the intention and belief that some of the money will be reimbursed to St. Matthews by the City of Lyndon and Louisville Metro Government.  The motion was seconded by Councilman Nay.
Upon vote:  (8-0) all were in favor and the motion was approved.

COMMITTEE REPORTS
• Councilman Shade said the remodeling of the women’s restroom closest to the library is well under way.  Additionally, she inquired if a pile of car parts located at the corner of Thierman Lane and Westport Road is allowed under the binding elements of the property.  And if so, could this area be screened?  Jack Ruf, St. Matthews Code Enforcement Officer, will investigate.
• Councilman Tonini articulated the Police Department is in the process of vetting potential new police officers.  Many qualified applicants have already applied.  On another subject, the police are responding to a resident complaint of speeding on Bauer Avenue.  Police have set up stations on Bauer Avenue and have been running radar.  To date, no speeding has been captured on the radar gun.  The police will continue to monitor this situation.  The Police Committee is looking at formulating a designated traffic unit.  In practice, these officers would be primarily responsible for running radar, making sure the speed limits are observed throughout our city, and responding to traffic accidents.  No definitive decision has been made on this idea.
• Councilman Nay made an inquiry about the vacant building at the corner of Shelbyville Road and Hubbards Lane.  Councilman Monohan informed the council it is his belief

this strip shopping center will soon be going under a facade renovation.  Jack Ruf said a potential tenant needs 2 additional parking spaces.  She then asked about whose responsibility it is to maintain the trees on Bowling Blvd.  Mayor Bowling indicated he believes it is to be maintained by Louisville Metro as it is not a City of St. Matthews Road.  He will ask Jim Birch, St. Matthews City Engineer, to look into getting the trees pruned either by Louisville Metro or St. Matthews.  On another subject, if anyone has any ideas on articles for the next newsletter, please verbalize them.  The next edition should go out in August.
• Councilman Flynn has been working on obtaining property and casualty insurance bids.  More information will be forthcoming in the next couple of weeks.
• Councilman Wissing raised the issue of the solid waste collection bid.  Foster Haunz has prepared a bid which has been distributed to each council member.  Councilman Weiter asked that we change the maximum requirement of 4-feet limb disposal to 6-feet.  While 4-feet is likely the national standard, we can ask that it be changed to no tree limbs longer than 6-feet will be picked up.  Councilman Tonini interjected that the limb length requirement may be directly connected to the width of the mouth of the truck.  Discussion followed regarding this issue and the issue if lids are supposed to be closed on the toters once they are emptied. It appears that on some routes the lids are closed and on other routes some lids are not.  Councilman Tonini said it all about the efforts of the individual people who are working the different routes.  Several council members asked the Mayor to submit a request in the bid for the cost associated with service without backyard pick-up. The Mayor said it could be an option.
MAYOR’S REPORT
Mayor Bowling informed the council that the Kentuckiana Planning and Development Agency (KIPDA) will be holding a community meeting in the STM Council Chambers on Thursday, May 24th.  The meeting will begin at 5:30 p.m. and expected is to last until 7:30 p.m.  All are welcome to attend.
He also complimented the St. Matthews Works Department for doing an excellent job at the recent Community Festival.  The Works employees were vigilant in overseeing and eliminating papers on the street and keeping the trash bins emptied.  The Festival appears to have been a

success and it is a compliment to see how so many people pulled together to produce such an event.

CITY ATTORNEY’S REPORT

City Attorney Foster Haunz, referring to the previous discussion related to the solid waste bid, said the bid process should be every 2 years with 1 year optional renewal by the city and 1 additional year renew by mutual agreement of the service provider and the city.
EXPENDITURES

Councilman Tonini made a motion to approve the expenditures listed and that checks are drawn on the city’s treasury in the amount of $101,528.46.  The motion was seconded by Councilman Schade.

Upon vote:  (8-0) the motion was approved.
ADJOURNMENT

Councilman Weiter made a motion to adjourn the meeting.  The motion was seconded by Councilman Nay.

Upon vote:  (8-0) the motion was approved and the meeting adjourned at 7:53 p.m.
