Council Meeting Minutes
April 12, 2022

A meeting of the St. Matthews City Council was held in-person on Tuesday, April 12, 2022. The meeting was called to order at 7:00 p.m. by Mayor Richard Tonini. The following people were present:

The Pledge of Allegiance was accomplished followed by the roll call vote of attendance.

MINUTES

A motion was made by Councilmember Monohan to approve the minutes from the March 22, 2022 council meeting. The motion was seconded by Councilmember Nay.

Upon Voice Vote: (7-0) the motion carried.

PUBLIC MEETING COMMENTS

Kate Leitner, Manager of the St. Matthews/Eline Branch of the Louisville Free Public Library gave an overview of events currently scheduled. Friends of the Library will meet on Tuesday, April 19th at 10:00 a.m. On April 20th a Paperclip Bookmark group will meet to make bookmarks. A Louisville Disaster Program will be held on April 26th. Various book discussion groups will be meeting and along with long-standing children’s’ story times. Individuals can make appointments with library staff members who can provide assistance in navigating technology.

NEW BUSINESS

ORDINANCE 22-02                     SHORT-TERM RENTALS                          JOHNS SINGLER, ATTORNEY
                                                 1st Reading

City Attorney John Singler summarized Ordinance 22-02 which clarify’ s parameters of short-term rentals within the boundaries of the City of St. Matthews. St. Matthews did not approve short-term rentals in 2016 when the Louisville Metro Land Development Code was revised. However, this ordinance specifically outlines the regulations for allowances. They would be allowed in areas currently zoned R-7 and CN (Commercial Residential) which provide for hotels, motels, and multi-family housing. Short-term rentals would not be allowed in areas zoned for single-family residences. Councilmember Nay inquired who would be approved if two neighbors both applied for short-term rentals. It was learned that applications will be approved on a first come, first serviced basis. Councilmember Nay then questioned the necessity of information found in “K”. Attorney Singler relayed that information is not necessary and can be eliminated. Councilmember Monohan made a motion to accept this as 1st reading of Ordinance 22-02. The motion was seconded by Councilmember Bowing.

Upon Voice vote: (7-0) the motion carried, and the ordinance will move forward for 2nd reading in 2 weeks.

MUNICIPAL ORDER 22-09           REQUEST FOR REFINANCING                 JOHN SINGLER, ATTORNEY
                                                 OF TAX BOND FOR MASONIC
                                                 HOMES OF KENTUCKY

Mark Franklin representing Masonic Homes of Kentucky, explained approval of this municipal order would allow the refinancing of debt. The state mandates that communities are notified. The City of St. Matthews does not incur any financial liability by the approval of this municipal order. Councilmember Monohan made a motion to accept MO 22-09. The motion was seconded by Councilmember Flynn.

Upon Voice Vote: (7-0) the motion carried.

MUNICIPAL ORDER 22-10           RDDDP and REVISED BINDING               JOHN SINGLER, ATTORNEY
                                                 ELEMENTS AT 6464 DUTCHMANS PARKWAY

Mr. Singler summarized MO 22-10 explaining this property has been 2 different lots and the applicant is requesting to be joined as 1 property. The change would require a new set of binding elements for 6464 Dutchmans Parkway and 6201 Dutchmans Lane. He further stated the larger building, former site of several restaurants, will be used for offices for Jaggers as well as test kitchen for new products. Should a future desire to separate the properties arise, it would be necessary for the owner to apply and complete thru the legal process. Councilmember Monohan made a motion to approve MO 22-10. The motion was seconded by Councilmember Flynn.

Upon Voice Vote: (7-0) the motion carried.

EXPENDITURES

Councilmember Weiter made a motion to approve the expenditures listed and have checks drawn on the city’s treasury in the total of $512,812.75. The motion was seconded by Councilmember Nay.

Upon Roll Call Vote: (7-0) the motion carried. Yes Votes: Councilmembers Clark, Holland, Weiter, Monohan, Bowling, Nay, and Flynn. No Votes: None.

COMMITTEE REPORTS

· Councilmember Holland relayed the Rental Committee will meet on Tuesday, April 19 at 3:00 p.m.
· Councilmember Monohan stated the Parks Committee met recently and determined the improvements to Warwick Park will be implemented in Phase I and Phase II over two budget cycles. Kenan Stratman, St. Matthews Public Works Director interjected about 5,000 of linear feet of additional walking path has been laid at Brown Park. It was found additional excavation and crushed stone will be needed in some of the existing areas.
· Councilmember Bowling mention the Police Awards Banquet will be held June 24th at the Community Center also known as The Arterburn.
· Councilmember Nay informed those present the next newsletter should be in homes on or around May 1st.

CITY ATTORNEY’S REPORT

· Mr. Singler stated 12 of 13 residents of Twinbrook subdivision have signed a petition to join the City of St. Matthews. The question remains how and when to move forward. The governor has vetoed a bill that would allow for the expansion of suburban cities. Also, does St. Matthews want to include the one property that the owner has not signed the petition to join? Councilmember Monohan suggest the city move ahead, where applicable with the residents who want to join St. Matthews. No person shall be forced to join that is not in full support.

MAYOR’S REPORT

Mayor Tonini had no report. However, St. Matthews Planning and Zoning Officer Jack Ruf asked the councilmembers to give input on the color samples provided by the owner of a proposed carwash on Shelbyville Road. The colors were discussed. Councilmember Flynn made a motion to approve SW Blondie #6128. The motion was seconded by Councilmember Weiter.

Upon Roll Call Vote: (5-2) the motion carried. Yes Votes: Councilmembers Holland, Weiter, Monohan, Bowling, and Flynn. No Votes: Councilmember Clark and Nay.

ADJOURNMENT

Councilmember Monohan made a motion to adjourn the regular meeting. The motion was seconded by Councilmember Flynn.

Upon Voice Vote: (7-0) the motion carried, and the meeting adjourned at 7:51 p.m.
