September 12 , 2023
A meeting of the St. Matthews City Council was held in-person on Tuesday, September 12, 2023. The meeting was called to order at 7:00 p.m. by Mayor Tonini. The following people were present:

MINUTES
A motion was made by Councilmember Nay to approve the minutes from the August 29, 2023 council meeting. The motion was seconded by Councilmember Olson.
Upon Voice Vote: (7-0) the motion carried.
PUBLIC MEETING COMMENTS
Kate Leitner, Manager of the St. Matthews/Eline Branch of the Louisville Free Public Library reviewed a list of upcoming events at the St. Matthews Branch.

NEW BUSINESS
ORDINANCE 23-05 AN ORDINANCE RELATING TO THE JOHN SINGLER, ATTORNEY
PARTIAL STREET CLOSURE OF
THOMPSON AVENUE
Mayor Tonini explained to the Council and those in attendance the historical facts on the closure of Thompson Avenue. He expressed his opinion to delay the process of this partial closure until more information is available.
Long-time residents David and Maria Marchal of 3620 Warner Avenue addressed the Council expressing their desire for the closure. He stated they had future home improvement plans which would enhance their property since they intend to remain in St. Matthews.
Mayor Tonini thanked Mr. Marchal and stated he had concerns regarding the fire hydrant that would remain and the expense to relocate it.
City Attorney Singler read by summary Ordinance 23-05 regarding the partial street closure of Thompson Avenue. Councilmember Nay made a motion for introduction and first reading of 23-05. Her motion was seconded by Councilmember Bowling.
Upon voice Vote: (7-1) the motion carried with Councilmember Landes abstaining.

MUNICIPAL ORDER 23-21 JOHN SINGER, ATTORNEY
A MUNICIPAL ORDER RELATING TO THE APPROVAL OF A REVISED DETAILED DISTRICT DEVELOPMENT PLAN AND RELATED WAIVER ON PROPERTY LOCATED AT 4630 WESTPORT ROAD
David Hill, Development Engineer for Choi’s Asian Food Market, addressed the Council regarding a 13,000 square foot grocery with a storage and food hall. Councilmember Nay asked if there had been a traffic study and Mr. Hill replied that Louisville Metro Planning and Design did not require one.
The Council asked numerous questions regarding the heavily traveled intersection where the business will be located and expressing their concern the corner will only encounter increased traffic issues. After much discussion, City Attorney Singler summarized the municipal order to include that there will be no free-standing signs. The delivery hours will be from 7 a.m. until 7 p.m. and no delivers will be made prior to 7 a.m. The business hours will be Monday-Thursday from 9 a.m. until 9 p.m., Fridays and Saturdays from 9 a.m. until 10 p.m. and Sundays from 9 a.m. until 8 p.m.
Councilmember Nay made a motion to deny MO 23-01. City Attorney Singler explained that a case can never be denied without a specific order of denial, but one can be written. Motion failed for lack of a second.
Councilmember Flynn made a motion to approve MO 23-01. His motion was seconded by Councilmember Landes.
Upon Voice Vote: (7-1) the motion carried with Councilmember Nay voting no.
EXPENDITURES
Councilmember Bowling made a motion to approve the expenditures listed and have checks drawn on the city’s treasury in the total of $300,721.84. The motion was seconded by Councilmember Nay.
Upon Roll Call Vote: (8-0) the motion carried.
COMMITTEE REPORTS
- Councilmember Hernandez had no report.
- Councilmember Clark had no report.
- Councilmember Olson reported the first recipient of the newly created “Outstanding Neighbor Award” was presented on September 2, 2023 to Wilbur Amick, 215 South Hubbards Lane, and he was nominated by Chelsea Albertson.
- Councilmember Holland had no report.
- Councilmember Bowling had no report; however, he announced Chief Barry Wilkerson’s family now has a new grandson born earlier in the day.
- Councilmember Nay stated that articles for the newsletter are due by this Friday, September 15, 2023.
- Councilmember Flynn had no report, but he encouraged the Council to schedule a Caucus meeting. A meeting was scheduled for Saturday, September 16, 2023 at 10:00 a.m. The discussion will be about the 2023 Light Up St. Matthews Event.
- Councilmember Landes had no report.
CITY ATTORNEY’S REPORT
Mr. Singler explained to the Council the process of a denial of a Municipal Order. He stated there is a statutory right to appeal any action for or against a zoning case. However, detailed finding must be presented at the time of denial.
MAYOR’S REPORT
Mayor Tonini had no report.
ADJOURNMENT
Councilmember Holland made a motion to adjourn the regular meeting. The motion was seconded by Councilmembers Olson.
Upon Voice Vote: (8-0) the motion carried, and the meeting adjourned at 8:16 p.m.
