The regular meeting of the City Council was called to order by Mayor Bowling at 7:00 p.m. The meeting was held at St. Matthews City Hall, 3940 Grandview Avenue.

Minutes

A motion was made by Councilman Tonini to approve the minutes from the September 27, 2011 meeting. The motion was seconded by Councilman Nay.

Municipal Order 11-13 Baptist Healthcare Systems Bond Request

Mr. Bill Davis spoke to the council asking for their approval of a bond issue for Baptist Healthcare Systems. The City of St. Matthews is no way liable for this bond and it does not count against what St. Matthews can allow for industrial revenue bonds. The Kentucky Economic Development Finance Authority (KEDFA) does require each city council to approve individual requests in order to issue bonds through the state agency. Most of the benefit from this bond will be directed to Central Baptist Hospital in Lexington. However, the St. Matthews campus will derive some upgrades, namely to increase the number of infant patient beds from two (2) to eight ( 8) in the neo-natal unit. Councilman Tonini made a motion to approve this request. The motion was seconded by Martha Schade.

Upon vote: (6-0), the motion was approved.

Ordinance 11-05 4315 N. Church Way – 1st Reading

Deborah Bilitiski presented proposed renderings of the property located at 4315 N. Church Way. Tafel Motors is asking the council to approve a zoning change from OR-3 to C-2 for this named property. With the zoning change, which includes the removal of the house located on this property, Mr. David Peterson, President of Tafel Motors, has agreed to landscape enhancements including trees and shrubs to serve as a visual buffer between the neighbors and Shelbyille Road. A neighborhood meeting brought no opposition to the plan from the neighbors. Councilman Nay made a motion to change the zoning of 4315 N. Church Way from OR-3 to C-2 accepting the landscape upgrades as discussed. The motion was seconded by Councilman Schade.

Upon vote: (6-0), the motion was approved.

This ordinance will have a seconded reading at the November 8, 2011 City Council Meeting. Councilman Monohan asked if Mr. Peterson would consider placing additional shrubs between the parking lot and the apartment building for the enhancement of the residents of the apartments. Ms. Bilitiski said she would make the request to Mr. Peterson and would send a letter confirming same before the next council meeting.

COMMITTEE REPORTS

· Councilman Monohan attended a meeting today regarding the parks. Dead trees are being identified and tagged for removal. More trees will be tagged next spring for the same process.
The park updates are really a 3-step process 1) removal of dead or deteriorating plants and trees, 2) the restoration of Beargrass Creek and 3) the replanting process. We are hoping to partner with Baptist East, the J. Graham Brown Center Foundation and LG&E regarding the replanting of native trees in approximately 18 months. Lastly, the Parks Committee met with Kenan at HDR Engineering Company on a long-term plan schematic, master plan for the parks in St. Matthews.
· Councilman Tonini brought to the attention of the council the police crime report for the last 2 weeks for their review. He also reported 2 STM police officers caught a suspected Jtown bank robber in St. Matthews recently while he was traveling through our city. The news media did not give the STM police department credit for the apprehension of the suspect. Discussion followed regarding publicity of our police department.
· Councilman Nay informed the council the fall newsletter is at the printers and should be in resident mailboxes in a week or so. She also handed out, to the Mayor and City Council members, a spread sheet usage report on the Call St. Matthews, 24/7 automated information system. The report covered several months of 2010 along with the monthly usage in 2011, in order to compare usage trends.

MISC

· Mayor Bowling stated that the ribbon cutting for the Brightside project at the Westport Road exchange will be held Thursday, October 13 at 10:00 a.m. Any council member that chooses to attend should park on Windhurst and then walk over to the interchange area. The four cities neighboring this interchange, St. Matthews, Graymoor-Devondale, Windy Hills and Woodlawn Park, have agreed to help maintain this interchange.
· Mayor Bowling asked City Attorney Foster Haunz to look into what the city can do about ambulances idling in Brown Park. The diesel engines create a strong odor that can sometimes not be pleasant to other visitors. He asked Mr. Haunz to research if a no-idle zone can be established for Brown Park.
· Councilman Nay asked Mayor Bowling about the status of the approval of the permanent Quiet Zone for the Train Whistles through St. Matthews. Mayor Bowling stated that St. Matthews has been granted the permanent Quiet Zone since the required improvements funded by St. Matthews to several crossings have been completed by the CSX railroad contractor. The Quiet Zone includes the crossings at Hubbard’s Lane, which CSX identifies as the City

of Richlawn. Mayor Bowling stated that the city is working to add the crossing at Washburn Avenue, identified as the City of Lyndon crossing by CSX, as an addition to the St. Matthews Quiet Zone area.
· Councilman Nay asked dif the St. Matthews Police Department and/or city council could send a letter or contact the Commonwealth of Kentucky Transportation Department about making some changes to the northwest exit of 264 to Shelbyville Road. This area has a long history of vehicle accidents as has been shown in the two police crime and accident reports. These reports have been distributed to the mayor and city council at the last town city council meetings. Mayor Bowling that he would have City Engineer, Jim Birch, who is a traffic engineer, look into this matter.

BILLS

Councilman Tonini made a motion to approve the expenditures listed and that checks are drawn on the City’s Treasury in the amount of $427, 678.11. The motion was seconded by Councilman Nay.

Upon vote: (6-0) the motion was approved.

ADJOURNMENT

Councilman Weiter made a motion to adjourn. The motion was seconded by Councilman Nay. All being in favor, the motion carried and the meeting adjourned at 7:49 p.m.
