Council Meeting Minutes

August 25, 2015

 The regular meeting of the St. Matthews City Council was called to order at 7:02 p.m.  by Mayor Richard Tonini.    The meeting was held at St. Matthews City Hall, 3940 Grandview Avenue.  The following people were present:

MINUTES

A motion was made by Councilman Nay to approve the minutes from the August 11, 2015 meeting.  The motion was seconded by Councilman Monohan.

Upon vote:  (8 -0) the motion carried.

PUBLIC COMMENTS

Robert Davis of N. Bonner Avenue brought three concerns before the council.  The first issue is a neighboring house which had a mattress in the front yard and currently has tree limbs that need to be discarded.  Jack Ruf relayed Code Enforcement Office Daryl Cleary is working on this issue with the homeowner.  The second issue is another neighbor who has several dogs that bark constantly.  Mayor Tonini asked Mr. Davis to call the St. Matthews Police when the dogs are barking allowing the police to address the problem with the neighbor.  Mr. Cleary has reported this same issue to Louisville Metro Animal Control Services, on behalf of Mr. Davis, as that agency has jurisdiction over problems with animals in all of Jefferson County.  The third issue was flooding in and around Mr. Davis’s house during the July 12, 2015 torrential rain storm.  The terrain of that area puts his yard at the lowest point, naturally where water will build up first.  Drainage pipes in that area were installed before St. Matthews was incorporated as a city.  Kenan Stratman, St. Matthews Public Works Director, said the storm water pipe, suspected to be initially installed by a developer in the late 1940’s, is quite old and most likely is blocked in places either from tree roots or broken pieces of terra cotta.  The city has made several assessment of the area seeking drainage improvements in the past.  MSD (Metropolitan Sewer District) has designed most drainage systems throughout the county to carry 3-4 inches of water in a 24 hour period.  The storms on July 12, 2015 dropped 9 inches of water in a 3-hour period.  Mr. Stratman also added preliminary work is being conceptualized to possibly bring sidewalks to N. Bonner.  It may be possible that some drainage work could be completed at the same time as the sidewalk construction.  Mayor Tonini asked Mr. Stratman to keep in touch with Mr. Davis on this issue.

NEW BUSINESS

EXPENDITURE REQUEST FOR ST. MATTHEWS LITTLE LEAGUE           Mayor Rick Tonini

The St. Matthews Little League has a shortfall and has requested a donation in the amount of $10,000 relayed Mayor Rick Tonini.  Councilman Holland asked that the Board members of the St. Matthews Little League review their budget for possible adjustments going forward.  It appears other little leagues are able to operate within the budget by having parents work the concession stand as an example.  Mayor Tonini stated a committee should be formed to communicate with the St. Matthews Little League Board members.  Members appointed to the committee are:  Councilman Frank Flynn, Councilman Pat Wissing, Councilman Tim Holland and Councilman Weiter.  Councilman Mary Jo Nay made a motion to donate $10,000 to the St. Matthews Little League.  The motion was seconded by Councilman Monohan.

Upon vote:  (8-0) the motion carried.  Yes votes:  Councilmen Holland, Weiter, Monohan, Schade, Bowling, Nay, Wissing and Flynn.  No Votes: None

ORDINANCE 15-03                 710 Breckenridge Lane                                  Foster Haunz

                                                1st Reading

Councilman Pat Wissing recused himself at 7:43 p.m. as a voting member of the St. Matthews City Council regarding Ordinance 15-03.  He sat with other members of the audience and spoke only as the applicant, not as a sworn council member.

City Attorney Foster Haunz summarized Ordinance 15-03 concerning a zoning change at 710 Breckenridge Lane along with a Revised Detailed District Development Plan and amending the binding elements.  Ann Richard of Land Design and Development, Inc., representing the applicant, Pat Wissing, spoke to the council on this issue.  The applicant has plans for an 8,000 square foot office building.  The set-back and parking do meet regulations for the amount of square feet.  This application does not including any request for signage.  Signage will be applied  for separately.    Councilman Schade inquired about the materials to be used for the exterior construction.  Mr. Wissing confirmed it will be a brick building.  Mr. Ruf made note of Binding Element #10 referring to an exhibit submitted at the June 6, 2013 Louisville Metro Planning Commission meeting.    Because the building design has changed and the new design was approved by Planning and Design staff, he felt it appropriate that the binding element be changed to August 25, 2015.  Councilman Monohan made a motion to accept this as first reading of Ordinance 15-03.  The motion was seconded by Councilman Bowling.

Upon Vote:  (7-0) the motion carried.  Yes Votes:  Councilmen Holland, Weiter, Monohan, Schade, Bowling, Nay and Flynn.  No Votes:  None.  Councilman Wissing abstained from voting.

Councilman Wissing then rejoined the St. Matthews City Council members on the dais.

EXPENDITURES

Councilman Bowling made a motion to approve the expenditures listed and have checks drawn on the city’s treasury in the total amount of $124,571.78.   The motion was seconded by Councilman Nay.

Upon Vote:  (8-0) the motion carried.  Yes Votes:  Councilman Holland, Weiter, Monohan, Schade, Bowling, Nay, Wissing and Flynn.  No Votes:  None.

COMMITTEE REPORTS

  • Councilman Weiter informed the group that he and Councilman Nay are vetting possible candidates or organizations to cover communications needs of the city.
  • Councilman Schade will soon start the process of redecorating the 3rd Floor Conference Room, the Council Room and the Administration Office. None of these offices have experienced any updates in the 21 years since the City of St. Matthews moved into this building, formally known as Future Federal Savings Bank
  • Councilman Bowling stated the body cameras should be here in September. The annual dinner meeting of the Jefferson County League of Cities will be November 19th at the Jeffersontown Community Center.
  • Councilman Nay said as of 7:00 p.m. this evening, 504 residents and/or business owners have signed up for Reach Alert.
  • Councilman Wissing mentioned he has made contact with the Chamber Executive Director Mike Chesser for possible meeting dates. Members of the St. Matthews Committee to meet with Mr. Chesser are Councilmen Pat Wissing, Chairman, along with Councilmen Weiter, Nay and Flynn.
  • Councilman Flynn relayed the health insurance premium has increased by only 5% for the upcoming plan year starting in October 2015. 

    CITY ATTORNEY’S REPORT

    City Attorney Foster Haunz had no additional comments at this time.

    MAYOR’S REPORT

    Mayor Tonini had no additional comments at this time.

    EXECUTIVE SESSION

    Councilman Weiter made a motion to recess the regular session and convene in Executive Session to discuss a personnel issue.  The motion was seconded by Councilman Nay.

    Up vote:  (8-0) the motion carried and the regular meeting was suspended at 8:07 p.m.  Yes Votes:  Councilmen Holland, Weiter, Monohan, Schade, Bowling, Nay, Wissing and Flynn.  No Votes:  None

    Councilman Monohan made a motion to conclude the executive session and reconvene to the regular session at 8:47 p.m. The motion was seconded by Councilman Nay.

    Upon Vote:  (8-0) the motion carried.  Yes Votes:  Councilmen Holland, Weiter, Monohan, Schade, Bowling, Nay, Wissing and Flynn.  No Votes:  None

    It was noted no action was taken during Executive Session.

    Councilman Bowling made a motion to adjourn the meeting.  The motion was seconded by Councilman Nay.
