The regular monthly meeting of the St. Matthews City Council was called to order at 7:00 p.m. by Mayor Bowling.   The meeting was held at St. Matthews City Hall, 3940 Grandview Avenue.  The following people were present:

MINUTES

 

A motion was made by Councilman Nay to approve the minutes from the June 24, 2014 meeting. The motion was seconded by Councilman Schade.

 

Upon vote:  (7-0) the motion passed and the minutes were approved.  Councilman Draut was absent and unable to participate in the vote.

 

 

PUBLIC COMMENTS

 

Mrs. Deb Hoskins asked to address the council members.  In a prepared statement, she thanked the council members for their unwavering support in keeping Elmwood Avenue and Washington Square dead end streets.   The attendees gave a standing ovation following the comments of Mrs. Hoskins.

 

Mr. Phil Riney asked for more police presence on Kennison Avenue for the purposes of deterring speeding.  The biggest problem tends to be between the hours of 4:00 p.m. to 6:00 p.m.  Councilman Tonini said he would have police officers run radar.  Additionally, we can place the Smart Trailer there ASAP.   Mr. Riney mentioned a petition was previously delivered to City Engineer Jim Birch regarding the possibility of installing speed humps.  Councilman Tonini said Jim Birch will be get back with him very soon on this issue.

 

Hunter Lewis, resident of St. Matthews, said he knows someone on Portland, Oregon that is looking to increase the beaver population in that area.  Mr. Lewis is aware beavers have created significant damage in Draut Park over the past several years.  Councilman Monohan, Chairman of the Parks Committee, responded he would like to investigate this possible avenue.

 

PENDING BUSINESS

 

ORDINANCE 14-04                 SIGN ORDINANCE

 

Discussion related to the sign ordinance remains as pending and was not on the agenda for discussion for this meeting.

 

 

NEW BUSINESS

 

Councilman Tonini made a motion to add to the agenda discussion regarding the proposed merger of the City of Richlawn with the City of St. Matthews.  Councilman Monohan seconded the motion.

 

Upon Vote:  (7-0) the motion passed.  Councilman Draut was not present and unable to participate in the vote.

 

 

ORDINANCE 14-07     MERGER OF THE CITY OF RICHLAWN – 1st Reading

 

Mr. Dirk Gowin, resident of the City of Richlawn, informed the St. Matthews council members Richlawn council members will soon be voting on an Ordinance regarding the proposed merger.   In order to proceed, it is his understanding it is necessary for the City of St. Matthews to adopt an ordinance indicating acceptance of the government and residents of the City of Richlawn should a ballot question pass by the majority vote.  Foster Haunz quickly formulated Ordinance 14-07.  It includes the following:  The City of St. Matthews having a common boundary with the City of Richlawn and in accordance with KRS 81A.530, will accept the residents and government currently associated with the City of Richlawn should the ballot measure pass by majority vote in the November 4, 2014 General Election.  Councilman Schade made a motion to accept this as first reading of Ordinance 14-07.  The motion was seconded by Councilman Monohan.

 

Upon vote:  (7-0) the motion passed.  Yes votes:  Councilmen Weiter, Monohan, Schade, Tonini, Nay, Wissing and Flynn.  No Votes:  Zero.  Councilman Draut was absent and unable to participate in the vote.

 

 

MUNICIPAL ORDER 14-04      5 GUYS

 

City Attorney Foster Haunz read MO 14-04 which would approve the proposed binding element agreement changing the structure located at 4226 Shelbyville Road to a restaurant with an outdoor patio.  Buffering and landscaping must be approved along the southwest property line.  Councilman Flynn made a motion to accept MO 14-04.  The motion was seconded by Councilman Monohan.

 

Upon vote:  (7-0) the motion carried.  No votes: Zero.  Councilman Draut was absent and unable to participate in the vote.

 

 

ORDINANCE 14-05     ESTABLISHING PARKWAY’s – 1st Reading

 

Ordinance 14-05 outlines the parameters that signs can be placed alongside parkways within the city limits of St. Matthews.  Terms and definitions are demarcated in addition to penalties.

Councilman Mary Jo Nay made a motion to accept as 1st reading Ordinance 14-05.  The motion was seconded by Councilman Weiter.

 

Upon Voice Vote:  (7-0) the motion carried. Councilman Draut was absent and unable to participate in the vote.

 

 

ORDINANCE 14-06     SIGN PERMIT FEE’s – 1st Reading

 

This ordinance asserts the repealing and re-enacting of Chapter 154 relating to sign permitting of the development code of the City of St. Matthews pertaining to sign regulations.  Discussion followed.  Councilman Weiter made a motion to accept as 1st Reading Ordinance 14-06.  The motion was seconded by Councilman Monohan.

 

Upon roll call vote: (6-1) the motion carried. Yes Votes:  Councilmen Weiter, Monohan, Schade, Tonini, Nay, and Flynn.  No Vote:  Councilman Wissing.  Councilman Draut was absent and unable to participate in the vote.

 

COMMITTEE REPORTS

 

  • Councilman Monohan relayed design work for specific projects at Community Center Park is near completion.On another matter, the water level at Draut Park has been lowered in an effort to discourage the beaver population from continuing to reside in their comfortable home on the range.  Work has begun on the improvements to Warwick Park which are being pursued with the assistance of Neighborhood Development Funds from the Office of Louisville Metro Councilman Ken Fleming.
  • Councilman Tonini informed those in attendance a robbery recently took place at Genesis Diamonds.One perpetrator has been arrested with additional arrests expected.  A retired detective has been hired as a part time patrolman.  The Public Works crew did a tremendous job cleaning up after a recent storm.
  • Councilman Nay said the newsletter is going to the printer soon and should be homes in the first week of August.

 

CITY ATTORNEY’S REPORT

 

Foster Haunz conveyed the sign appeal made by Mini Cooper has been withdrawn.

 

MAYOR’S REPORT

 

Mayor Bowling had nothing further to report.

 

EXPENDITURES

 

Councilman Tonini made a motion to approve the expenditures listed and have checks drawn on the city’s treasury in the total amount of $236,844.27.  The motion was seconded by Councilman Nay.

 

Upon vote:  (7-0) the motion carried.    Councilman Draut was absent and unable to participate in the vote.

 

 

ADJOURNMENT

 

Councilman Tonini made a motion to adjourn.  The motion was seconded by Councilman Weiter.
