SPECIAL VIRTUAL Council Meeting Minutes
March 9, 2021

A special meeting of the St. Matthews City Council was held VIRTUALLY on Tuesday, March 9, 2021. The meeting was called to order at 7:00 p.m. The following people were present:

PLEDGE OF ALLEGIANCE

The Pledge of Allegiance was accomplished followed by the roll call vote of attendance.

MINUTES

A motion was made by Councilmember Nay to approve the minutes from the February 23, 2021 special council meeting. The motion was seconded by Councilmembers Clark and Olson.

Upon Voice Vote: (8-0) the motion carried.

PUBLIC COMMENTS

No one had any comments to add due to special meeting status.

PENDING BUSINESS

City Engineer Jim Birch gave a brief update on the Trinity Hills drainage project. HDR Engineering is working on a final design to submit for approval. If plan is approved, there will be a minimum of 6-8 months before the project moves to the bidding process. Weather is a factor in attempting to move underground utilities.

NEW BUSINESS

MUNICIPAL ORDER 21-01            AMENDMENT TO ELEMENT #3        JOHN SINGLER, ATTORNEY
                                                  161 CHENOWETH LANE

Mr. Singler summarized MO 21-01 which would amend a binding element that has been in place since the 1980’s. St. Matthews Planning and Zoning Officer Jack Ruf interjected additional details. The property recently sold, and the new owner applied for a sign permit. During that process it was discovered the previous owner had installed an awning which was not in compliance with the binding elements. The current owner has applied to amend binding element #3 to allow an awning bearing a sign. Various questions were asked by councilmembers and answered by Mr. Ruf. Councilmember Clark made a motion to accept MO 21-01. The motion was seconded by Councilmember Nay.

Upon Voice Vote: (8-0) the motion carried.

EXPENDITURES

Councilmember Bowling made a motion to approve the expenditures listed and have checks drawn on the city’s treasury in the total of $259,196.61. The motion was seconded by Councilmembers Weiter and Olson.

Upon Roll Call Vote: (8-0) the motion carried. Yes Votes: Councilmembers Bowling, Clark, Holland, Monohan, Nay, Flynn, Olson, and Weiter.

COMMITTEE REPORTS

· Councilmember Bowling deferred to Chief Wilkerson for a report on the Police Department. Sgt. Parson’s is resigning effective at the end of March. Interviews will be held to fill 3 part- time openings. One current full-time officer may choose to move to part-time as well.
· Councilmember Nay inquired about the timeline to re-open the parks. Mayor Tonini relayed the playground is open with signage reminding parents the structures are not wiped down between children playing. The basketball rims and nets have not been reinstalled because basketball players do make physical contact when playing. It is unknown when the basketball games will commence. The baseball fields officially have an opening date of March 15th but that is somewhat arbitrary and may change depending on covid numbers and Governor Beshear’s directives.
· Councilmember Flynn said he would like to have an insurance committee meeting sometime within the next week to discuss possible big changes in employee health insurance. He then inquired about progress concerning noise complaints from residents in The Springs subdivision. Mayor Tonini stated he had visited Home Depot and spoke with the Assistant Store Manager about outside storage of materials and backup noise from forklifts. Mayor Tonini further stated that he left his business card with contact information, requested the store manager call him, but has yet to be contacted. The area behind the store has been significantly cleaned-up. Attorney Singler interjected that he is researching regulations utilized by other cities that could possibly be applicable to St. Matthews as a whole. Councilmember Flynn inquired about status of road closings for Washington Square, Elmwood, and Leland Avenues. Mr. Singler stated an encroachment ordinance has been updated which would require approval from the St. Matthews City Council before any changes could take place. Right-of-way closure could also mean a lawsuit would have to filed in Jefferson Circuit Court.

CITY ATTORNEY’S REPORT

Mr. Singler had no additional comments.

MAYOR’S REPORT

Mayor Tonini discussed the following items:

· The city will revisit the possibility of holding in-person council meeting for the month of April 2021. At this time, there are many people who have not had vaccinations. Discussion will take place at the March 23rd Council meeting in earnest about the best time to open for in-person meetings again.
· Mayor Tonini asked Jack Ruf to give a summary of regulations geared towards vaping shops. Mr. Ruf relayed Louisville Metro amended their regulations last fall stating they cannot be located within so many feet of a school etc. Currently there are no longer any vaping type businesses in the City of St. Matthews which may be the best time to revisit regulations. Councilmember Monohan stated he felt it was logical to be consistent with Louisville Metro. Mr. Singler said he would develop a proposed set of regulations for the councilmembers to consider.
· Mayor Tonini updated the council members on the status of the elevator at City Hall. It was learned the rails are a unique installation. A quote has been received from Murphy Elevator. Another quote from DC Elevator is expected soon.
· The city has purchased many trees for planting this spring. If any resident would like a tree for their front yard right-of-way, please contact City Hall.
· Studio Kremer has submitted a proposal for the St. Matthews Community Center. However, none of the councilmembers where able to open the e-mail attachment. Kenan Stratman will resend in a different format.
· Mayor Tonini announced that the Office of the Property Valuation Administrator (PVA) will reassess St. Matthews residential and commercial properties in the Spring of 2021. A public forum zoom meeting hosted by the PVA will be held on Tuesday, March 30th at 6:30 p.m. for Area 3 which encompasses St. Matthews. Information to connect to the zoom meeting can be found on the St. Matthews website or the PVA’s website.
· Josh Suiter, Director of Membership for the Chamber of St. Matthews, expressed his appreciation to the St. Matthews Police Department who won the annual Chamber Community Service award.

ADJOURNMENT

Councilmember Flynn made a motion to adjourn. The motion was seconded by Councilmember Weiter.

Upon Voice Vote: (8-0) the motion carried, and the meeting adjourned at 8:05 p.m.
