The regular meeting of the City Council was called to order by Mayor Bernie Bowling at 7:00 p.m. The meeting was held at City Hall located at 3940 Grandview Avenue.

MINUTES: Motion was made by Councilman Mary Jo Nay to approve the minutes from the July 26, 2011 meeting. The motion was seconded by Councilman Tony Weiter.

Municipal Order 11-09 – Property at 133 Chenoweth Lane
City Attorney Foster Haunz asked the council to consider the current binding elements on property located at 133 Chenoweth Lane. Phil Bills distributed pictures and plans to revitalize
the building owned by Dr. Gupta. Councilman Tonini asked if any residential property is in view of the back parking area. Mr. Bills and Dr. Gupta confirmed it is. To be considerate of the
residential neighbors, Dr. Gupta agreed to erect a 6-foot wood privacy fence blocking the view of the parking lot located at both of his properties, 133 Chenoweth Lane and 135 Chenoweth Lane. Councilman Tonini made a motion to approve Municipal Order 11-09 to place a 6 foot wood privacy fence along the backside of 133 Chenoweth Lane owned by Dr. Gupta. The motion was seconded by Councilman Tony Weiter.
Upon vote (8-0) the council approved the motion.
Councilman Frank Flynn asked the councilmember’s to consider sponsoring the St. Matthews Fire Fighters in the Combat Challenge Team exhibition. The team is comprised of St. Matthews firefighters and it promotes professionalism, teamwork, physical fitness and raises the visibility of St. Matthews. Councilman Mary Jo Nay made a motion to sponsor the Combat Challenge Team in the amount of $3,500. The motion was seconded by Councilman Wissing.
Upon vote (8-0), the motion was unanimously approved.
ORDINANCE 11-04
Mayor Bernie Bowling introduced the 2nd reading of Ordinance 11-04 regarding the sale and use of fireworks within St. Matthews city boundaries. Chief Mayer and the St. Matthews Police will be responsible for enforcing the ordinance should it pass. Mr. Haunz read the ordinance which also contains penalties for violation of this ordinance. Councilman Tonini made a motion to accept the ordinance as it is presently written. The motion was seconded by Councilwoman Mary Jo Nay.
Upon vote (7-1) the council approved the motion. Councilman Wissing was the descending vote.

BILLS
The council members were asked to review the list of expenditures for the City of St. Matthews. Councilman Tonini made a motion to approve the expenditures in the amount of $110, 383.39. The motion was seconded by Councilman Nay.
Upon vote (8-0) the motion passed.
COMMITTEE REPORTS
Councilman Weiter
Reminded council members that the St. Matthews Area Business Association will be hosting a breakfast meeting at the Olmstead next Wednesday, August 17th . The meeting begins at 7:30 a.m. and ends at approximately 9:00 a.m. The speakers at the meeting will be the candidates for Kentucky Governor. As of this date, only David Williams has confirmed that he will participate.
Councilman Monohan
Informed the council that the improvements at the Community Center Park are progressing. There are currently many small issues to address in regards to cosmetic appearances of the park. The public works department will work on most of these.
The eradication of non-native plans at Browns Park will take place this fall in order for other improvements to take place next spring. Councilman Wissing inquired if the piece of the playground equipment at Browns Park that resembles a monkey bar could become a slide, and described a few areas on the playground padding that may need to be repaired. Councilman Monohan said he would be happy to discuss this issue further after gathering more details. Mayor Bowling said we may need to look at the condition of the padding around the play ground equipment. If any repairs need to be made it should happen in the off season.

Introduced Officer Jonathan Smith who will soon be joining the St. Matthews Police Department. He is a St. Matthews resident, speaks Spanish and comes to us with an excellent recommendation from the Chief of the Shepherdsville Police Department.

He is also in the military reserves and previously served in Iraq. Officer Smith will take the oath of office at the next meeting.
He then relayed two positive reflections on the St. Matthews Police Department.
(1) Recently Officer Jeff Ball, SRT Hostage Negotiator, talked to a person in crises. During the interaction Officer Ball was able to convince the gentleman that he really needed to go to a hospital. The gentleman eventually agreed and was transported peacefully.
(2) Several police officers found another gentleman who had serious medical issues, who was waiting for his car to be repaired at a local shop. The man was without immediate resources for him or his dog, and had no place to go. He was staying in his car, in the extreme heat, without air conditioning. The officers took him and his dog to an Extended Stay motel and made sure they both had a meal or two. The officers paid for the hotel and meals from their own funds. Councilman Tonini said it was so refreshing to see how our officers reached out to people in need. Stories such as this are not often found in the newspaper but it is a slice of the good things happening in our community that the TV does not report.

The August 2011 edition of the city newsletter has been printed and is due to be in the residents homes shortly. Additional copies can be found in the hallway of the city hall and in the Eline Library.
Councilman Frank Flynn
Inquired if the auditors had begun the auditing process for the immediate past fiscal year. Mayor Bowling informed Councilman Flynn and the rest of the council that the audit actually began in July of 2011 and should conclude by October 2011. Councilman Flynn inquired if we could change auditors every 5 years or so. Mayor Bowling said we would look at this issue further before next year’s audits begin.
At this time, the Councilman Tonini made a motion to convene into Executive Session to discuss pending litigation. The motion was seconded by Councilman Nay.

Councilman Schade a motion to adjourn from Executive Session. The motion was seconded by Councilman Tonini.

Upon return from executive session, Councilman Nay made a motion to adjourn. The motion was seconded by Councilman Schade. All being in favor, the motion carried and the meeting concluded at 8:04 p.m.
