CITY OF ST. MATTHEWS Council Meeting Minutes April 27, 2021
A meeting of the St. Matthews City Council was held both in-person and virtually on Tuesday, April 27, 2021 at St. Matthews City Hall, 3940 Grandview Avenue. The meeting was called to order at 7:04 p.m. The following people were present:

MINUTES
A motion was made by Councilmember Nay to approve the minutes from the April 13, 2021 council meeting. The motion was seconded by Councilmember Weiter.
Upon Voice Vote: (7-0) the motion carried.
PUBLIC COMMENTS
Gary Major, resident of St. Matthews, suggested the council members consider placing the council meetings live, on-line. The matter will be researched for technical, practical, and legal issues associated with taking action on this matter.
Kate Leitner, Manager of the St. Matthews/Eline Branch of the Louisville Free Public Library, gave an overview of upcoming events at the local library. There will be a virtual movie discussion on May 18th ta 2:00 p.m. as well as a book discussion on the same day at 6:30 p.m. Many other Louisville Free Public Library events can be found on-line at www.lfpl.org.
PENDING BUSINESS
Mayor Tonini and Kenan Stratman, Public Works Director for the City of St. Matthews, gave a brief overview of the Trinity Hills Drainage Project. The Louisville Water Company hopes to finalize their plans to move a water line by the end of this week. A field supervisor will be on site during the actual work. An underground, natural spring runs under or near a couple of the houses. A new catch basin has been installed to help divert water away from homes.
ORDINANCE 21-03 REGULATION OF SMOKE SHOPS CARRIE RITSERT, ATTORNEY
2nd Reading
Attorney Ritsert read Ordinance 21-03 for 2nd reading by summary indicating this ordinance closely mirrors the Louisville Metro Ordinance addressing the same issue. The amount of sales for tobacco and subsequent products will be determined by percentage of sales for these related items. Councilmember Amy Olson made a motion to accept this as 2nd reading and for final passage of Ordinance 21-03. The motion was seconded by Councilmember Nay.
Upon Voice Vote: (7-0) the motion carried. Yes Votes: Councilmembers Clark, Holland, Weiter, Bowling, Nay, Flynn, and Olson. No Votes: No.
NEW BUSINESS
MUNICIPAL ORDER 21-03 APPT of OFFICER SHAUN SARGENT RICK TONINI, MAYOR
Mayor Tonini asked St. Matthews Chief of Police Barry Wilkerson to introduce Officer Shaun Sargent. We learned Officer Sargent previously worked for Louisville Metro Corrections. He then subsequently was an officer with LMPD where he requested to patrol in the 1st Division. He comes highly recommended to the St. Matthews Police Department. Officer Sargent expressed his appreciation and gratitude for being able to join the SMPD and looks forward to serving the community. Councilmember Nay made a motion to approve MO 21-03. The motion was seconded by Councilmember Bowling and Weiter.
Upon voice Vote: (7-0) the motion carried.
DISTRIBUTION OF QUARTERLY FINANCIALS
A summary of expenditures and revenue for the first 9- months of the fiscal year were distributed for councilmember review. Councilmember Bowling noted expenses and revenue should be at approximately 75% of the annual amount budgeted. To date, expenses and revenues are generally in line with projected budget allotments.
EXPENDITURES
Councilmember Bowling made a motion to approve the expenditures listed and have checks drawn on the city’s treasury in the total of $334,848.56. The motion was seconded by Councilmember Nay.
Upon Roll Call Vote: (7-0) the motion carried. Yes Votes: Councilmembers Bowling, Clark, Flynn, Holland, Nay, Olson, and Weiter.
COMMITTEE REPORTS
· Councilmember Flynn noted the Insurance Committee members will likely meet next week regarding the possibility of changing health insurance companies. FSA (Flexible Spending Accounts) and HRA’s (Health Savings Account) are due to renew on July 1, 2021.
· Councilmember Nay reflected on the excellence of product produced by Beth Jost for the last 9 years as author and editor of the “St. Matthews Living” newsletter. Many, many compliments have been received over the years from residents and business owners alike for the newsy and helpful content. Ms. Jost has resigned to care or an ailing family member. We applaud her efforts for helping to create a sense of community in St. Matthews and she will be missed. The next newsletter should be in homes on or about May 1, 2021.
CITY ATTORNEY’S REPORT
Ms. Ritsert had nothing additional to report.
MAYOR’S REPORT
Mayor Tonini discussed the following items:
· An inquiry on the status of the Massie Avenue Development was asked recently to a councilmember by a resident. Kenan Stratman relayed he had heard but it has not been confirmed a newer version of the project has been approved at staff level at Louisville Metro. However, nothing official from Louisville Mero has been received at this time by St. Matthews Planning and Zoning Officer Jack Ruf.
· Mayor Tonini asked Jack Ruf to give a brief update on the Home Depot code enforcement violation. Several meetings have taken place along with numerous phone calls. The last inspection completed by Mr. Ruf was on Tuesday, April 27 and it appears the outdoor surrounding at Home Depot were found to be consistent with the binding element requirements.
· Mayor Tonini mentioned the Office of the Property Valuation Administrator released updated property valuations. Many properties received significant increases and a few even decreased. The guidelines for the appeals process can be found on the PVA website.
· Kenan Stratman distributed a comparison of costs and timelines from 2 different companies for the repair and/or replacement of the elevator at City Hall. The jack on the elevator failed on December 31, creating smoke and subsequently an emergency run from the Fire Department. A 3rd company, Otis Elevator does not provide complete replacement work like DC Elevator and Murphy Elevator and could not be considered for the project. After thoughtful discussion, Councilmember Nay made a motion to accept the bid of DC Elevator the total replacement of the elevator at City Hall up to the cost of $110,000. The motion was seconded by Councilmember Weiter.
· Mr. Stratman then reviewed the placement of 6 plaques that will be placed on city property. Description of the plaques along with the 3 bids were reviewed. It was noted that Mayor Tonini was not in any way involved with the process. One correction was noted before the plaques are made. Councilmember Weiter made a motion to accept the lowest bid from Tonini Church Supply for the plaques. The motion was seconded by Councilmember Nay. Upon Voice Vote: (7-0) the motion carried.
· The next item discussion was the possible construction of a sidewalk on the east side of N. Hubbards Lane between Westport Road and Rudy Lane. Mr. Stratman met with Steve Kurowsky from Louisville Metro Public Works partnering with Louisville Metro to install a sidewalk on the east side of N. Hubbards Lane between Westport Road and Rudy Lane. There is a 4-foot sidewalk along the west side of the same section of road. The approximate cost is $175,000 but could be higher because acquisition of rights-of-way would likely need to be purchased. Mayor Tonini suggest that research is completed regarding obtaining additional funding sources.
